Privacy Policy

Privacy Policy – CARDATA Systems

This English translation is provided for convenience only. In the event of any discrepancy between the Hebrew and English versions, the Hebrew version shall prevail.

Who we are

1. The website, the forms management system, the tyre data information system, the engine data information system and the vehicle emissions data information system (the "System") are operated by CARDATA – Data Repositories (Israel) Ltd., of 9 Ahi Eilat Blvd., Haifa, through various means such as a website, an application, a personal system and the like. The Company, its owners, directors, employees, representatives and anyone acting on its behalf (wherever or however the System is provided) are referred to below, jointly and severally as the case may be, as the "Company" or "we".

2. This document supplements and is in addition to everything stated in the Terms of Use and in the other statements and descriptions on the Company's website, in the application and in any other medium. The definitions, terms and everything else stated there also apply to this document, with the necessary changes. Please read them.

3. We respect the privacy of our customers, the various users of the System and any other person who takes an interest in information through the System.

4. This privacy statement and policy will be updated from time to time, and at all times only the latest version at the relevant time shall be binding. If you do not agree to the wording as it stands at the time you take any action, please do not take it. Taking any action, such as providing information and the like, means that you have read what is set out below and agreed to it. Previous versions of the policy will be published at the bottom of this page by date of change.

5. Section headings are for convenience only, are not binding and do not serve as an aid to interpretation.

Information collected

7. The System collects usage data and information about you and about the vehicles entered into the System in order to provide the services set out in our Terms of Use and in the System itself.

8. We do not collect personally identifiable information about you, except where you provide such information (for example when placing orders through the System) and/or provide details required in order to use the System (for example when contacting our customer service, which requires the information you provide, or when registering for the System).

9. The information we hold is collected from a number of sources. For example:

10. Information you provided when registering for the System or that you provide at any future stage (for example when ordering forms and paying for them).

10.1. Information about vehicles provided to us when filling in a form, for example a registration (licence plate) number or a VIN.

10.2. Information collected about the vehicle from open and/or public sources, online or offline, for example used-car sales websites.

10.3. From registered government databases, such as the Ministry of Transport database.

10.4. From various service providers, such as insurance companies, vehicle and spare-parts importers and the like.

10.5. From enquiries made directly to us and/or to our customer service.

10.6. Location information (geolocation).

11. We may operate automated tools to profile the uses of our System, to update it remotely, to adapt it to your preferences, and to provide optimal and fast service. These tools may collect and store general, non-identifying information about you and about how you use the System, including your internet service provider details, your IP address, the location of the device used to access the System, the times and manner of use of the System, your browser type, reports you ordered and/or advertisements you responded to, and other statistical details indicating how you use the System.

12. We may operate automated tools (including ones that affect your device and load files onto it) in order to save the details you entered, the pages and reports you visited, the manner and duration of your actions in the System and the like.

13. The data stored by us consists mainly of your contact details and any detail relevant to the history of every vehicle documented by us, regardless of ownership. The information we collect includes the following types of information:

14. Your information, based mainly on contact details such as name, address, email address and telephone number. We will not collect sensitive personal information such as age, payment details and the like, unless you expressly approve it (for example when making a payment to our System; in such cases we will collect relevant sensitive information, as stated).

15. Information provided to the System on your own initiative, whether online, to a representative in contact with you, or the like. Such information may relate both to you and to the vehicles entered.

16. Please note that you are not obliged to provide us with all of the details listed above, or any of them. However, if you do so, you will be deemed to have agreed to everything stated in the Company's Terms of Use and to any use by the Company of that information in accordance with the Company's Terms of Use and Privacy Policy.

17. Insofar as you provide and/or upload any personal information to the System and/or to our database, you thereby declare that the information you provide will be correct, reliable, complete, up to date and accurate, that you provide the information of your own free will, in your own name and for yourself only, or that you are lawfully authorised to provide this information on behalf of another, and in any event you will be solely responsible for this information and for the consequences of its use.

18. Please make sure that if you decide to provide us with details, they are complete, correct, accurate and up to date. Acting otherwise may create legal liability towards third parties, and you alone will be responsible for any incorrect data you provided or failed to provide.

19. In addition, we collect details about the various vehicles documented by us that are published in public databases, for example by the Ministry of Transport and the like.

20. The information is stored by us on our servers, located at the Partner Business server farm (the Yoel farm) in Rosh HaAyin, and may also be transferred for storage in the United States or in Europe.

Cookies

21. As part of the use of the System (on various platforms such as an application, website, service terminal and the like), we use means of collecting non-personally-identifying information, such as cookies, Facebook Pixel, tags, beacons and others, for the routine and proper operation of the System. We use these means to collect data about your use of the System, to verify your details, to adapt the site to your personal preferences, to save the details of the vehicle being handled, to eliminate the need to re-enter your details each time, for information security purposes and the like.

22. Cookies, for example, are text files that your browser creates on your computer at the instruction of the site's computers. Some cookies expire when you close your browser and others are saved on your computer (and not by the site). If you do not wish to receive cookies, you can avoid them by changing your browser settings. However, remember that disabling cookies will mean you cannot use some of the services and features on various sites, including those of the Company. In addition, you can delete the cookies on your computer at any time.

Use of the information collected

23. The information you provide to the Company, as well as information about vehicles collected by the Company from other sources, will be used by the Company to build the database and to grant access to the database in accordance with the various services. This information will not be kept confidential, and if you do not wish this, please do not provide us with any information.

24. Only sensitive personal information will be kept confidential, such as your payment details, ID number, the history of the reports you produced, the number of vehicles you have had, and your private enquiries to us.

25. The information collected by the Company will be used only in accordance with this Privacy Policy or in accordance with the provisions of any law and/or any competent authority, for the purposes set out below:

25.1. To send the form to the System and to the vehicle inspection centre.

25.2. To store and use the database in the System, in order to disclose to third parties the fullest possible details about every vehicle tagged in the database.

25.3. To produce for you the reports you requested.

25.4. To present you with offers from third parties relating to products or services in the automotive field and related fields that may interest you. The offers will be sent to you by any relevant means of communication, such as email and mobile phone (e.g. SMS).

25.5. To adapt the System to your needs, including by making offers tailored to you.

25.6. To improve and enrich the services and content offered in the System, including creating new services and content that meet the requirements and expectations of the System's users, and to discontinue any existing service and/or content.

25.7. To contact you when necessary.

25.8. For any analysis and production of information, statistical or personal, for the System and for advertisers and other third parties.

25.9. For any other purpose set out in this privacy statement and policy or required under the System's Terms of Use.

Electronic direct mailing

26. We and/or anyone on our behalf, or any supplier and/or service provider contractually connected with us, may send you direct mailings, by email, short text messages (SMS), social media such as Facebook, and any other media, containing information about services, reports or third-party offers related to services for the vehicles you handle, as well as other promotional information, ours and that of other businesses connected with us, for example business insurance, spare parts and the like.

27. Such information will of course be sent to you only if you have given your consent or if it may be sent to you in accordance with the law. You may of course withdraw your consent to receiving the messages at any time by sending a "remove" message to the source from which you received the message, or to the email address info@cardata.co.il.

28. It is clarified that you have the right to send, at any time and in any medium in which you received such a promotional message, a written notice that you refuse to continue receiving information or publications by direct mailing, thereby withdrawing your consent. Such a removal notice will apply from the date it is sent onwards only.

29. It is clarified that receiving promotional and/or marketing information is not a condition of your use of the System and you are not obliged to agree to it.

30. It is also clarified that removing the application (or any other medium of the System) does not constitute cancellation of the permission you gave to send promotional messages, and you must carry out such removal yourself if you so wish.

​Disclosure of information to third parties

31. Please note that all information and data provided to the Company (except your payment details, the history of services and/or reports you produced, and the number of vehicles you have had) will be public and will be presented, in the course of our business and that of our partners, to any third party requesting these details.

32. Among others, these details will come to the knowledge of, or be provided to:

32.1. Our employees and all our representatives.

32.2. The employees and representatives of our business partners (such as insurance companies, vehicle importers, spare-parts companies and the like).

32.3. Statistical or other non-personally-identifying information that will help various advertisers tailor the advertisements and offers presented to you.

32.4. If you breach the System's Terms of Use or any other binding legal document in the System (including by providing missing, partial, incorrect or inaccurate information), or if you carry out, through or in connection with the System, any actions that appear to be contrary to law, harmful to third parties, in breach of contract, or liable to endanger or damage the System, including any attempt to do so. In such cases, the Company may disclose the information as required;

32.5. If the Company receives a court order or other instruction from a competent authority directing the Company to disclose your details or the information about you, to the extent set out in that order;

32.6. In any dispute, claim, demand or legal proceedings, if any, between you and the Company or anyone on its behalf;

32.7. Where the Company believes that disclosure of the information is necessary to prevent serious harm to your person, property or reputation, to those of the Company, or to the person or property of a third party;

32.8. Between companies affiliated with the Company, or if the site and/or its business are sold and/or transferred to others, provided that they too are bound by this policy.

33. We are not, and will not be, responsible for the use of information about you received from, or provided to, third parties not under our control, including but not limited to commercial companies, insurance companies, websites and applications and the like. In case of doubt, please check with them their privacy policy and the way they collect, store and use information, as well as their procedures.

Information security

34. We operate and implement up-to-date and continually updated systems and procedures for securing the information in the database. Although these measures significantly reduce the risk of unauthorised intrusion into the database, they cannot of course provide perfect security against database breaches and information leaks.

35. We also comply with all legal requirements applicable to us, including the Protection of Privacy Regulations (Data Security), 5777-2017, as they apply to us.

36. We do not undertake that our servers will be completely immune to unauthorised access to the information stored on them.

37. If such a breach has occurred and there is concern that a large amount of information has been exposed (as distinct from small-scale incidents), we will act in accordance with the law.

Third-party advertisements

38. Various advertisements on the site may operate cookies (or other tracking mechanisms) of commercial companies other than the Company. The use these companies make of cookies and similar mechanisms is subject to their privacy policies and not to this policy of the Company. These companies have no access to the Company's cookies and the Company has no access to theirs.

Right to review information and removal from mailing lists

39. Information will be kept in our database for as long as we need it. The database will be registered, and its number will be published in the Privacy Policy as updated from time to time.

40. Under the Protection of Privacy Law, 5741-1981, every person is entitled to review, personally or through a representative as set out in the law, the information about them held in a database. A person who has reviewed the information relating to them and found it to be incorrect, incomplete, unclear or out of date may contact us with a request to correct or delete the information. This process is defined by law, and requests should be sent to us by email to info@cardata.co.il, or by post to CARDATA – Data Repositories (Israel) Ltd., 9 Ahi Eilat Blvd., Haifa 2610301, Israel.

41. Accordingly, should you ask to remove your details from the mailing list (and you are entitled to do so by law), even after having registered for it, we will do our best to carry out your request within a reasonable time in the circumstances; however, given the nature of the database, we will have to make a public record of the editing action you requested.
